Jet Ski Problems

The practice of spraying boats with the fast turn as committed by this individual is as we know not new. It is at best, behaviour which causes alarm and distress and as you know can be dealt with under the Fixed Penalty system with an £80 sting in the tail. This was the legislation we employed last season at Herne Bay that went through the PWC community there like wildfire. However there are other tools in the bag. If the manoeuver causes other problems, then Careless Navigation will be considered under the by-laws. The excess speed issue we have tried to combat by the deployment of the laser speed gun but have yet to 'be in the right place at the right time', this is a new direction for us but we have spent so long in the education phase that we clearly now have to get tough.
The more draconian direction to take, which I have had in the wings up until now is the use of criminal law. The act as you describe will no doubt cause damage to property within the victim's vessel. The waterproof clothing etc is not bothered, but on a sunny day, the average boat owner will have the companionway open, other clothing, food items, cameras, ipods, etc in the cockpit. All these will be damaged in the act, this, the CPS representatives in the Medway and Swale Areas agree may constitute Criminal Damage, making the PWC rider arrestable and possibly imprisonable. The incident in the East Swale last year when the trot boat employee was injured in his efforts to avoid what he perceived to be an attempted ramming, was recorded as an assault occasioning Actual Bodily Harm, again a criminal act with all the law provides as punishment. We cannot stress strongly enough that this is not acceptable behaviour, and all we need for a successful prosecution is the identification of the offender. Photographic or video footage is of course best evidence, but as you say, make, model and description of the PWC, datatag reg. number and a description of the rider would be a great start.
